A thoracic spine fracture is a break or dislocation of one or more vertebrae in the mid-back region, typically between the T1 and T12 vertebrae. It is often caused by trauma, such as falls, car accidents, or high-impact sports. These fractures can vary in severity, from minor compression fractures to severe injuries that may involve spinal cord damage. Symptoms often include back pain, limited mobility, and, in severe cases, neurological issues like numbness or paralysis. There are some scenarios where this type of injury can be directly attributed to the negligent or reckless behaviour of a third party. In these scenarios, it may be possible to bring a personal injury compensation claim.
Can negligence in the workplace lead to this type of fracture?
Yes. This type of injury might occur if employers fail to provide proper safety equipment, neglect to enforce safety protocols, or do not adequately train staff in handling heavy machinery or materials. Unsafe working conditions, such as unprotected heights, slippery surfaces, or poorly maintained equipment, can also increase the risk of falls or accidents. Workers in construction, manufacturing, and other physically demanding jobs are particularly vulnerable. When these safety failures occur, employees may suffer severe injuries, including thoracic spine fractures, due to preventable workplace hazards.
Can negligence in public spaces lead to this type of fracture?
Yes. Poorly maintained environments, such as uneven pavements, wet floors without warning signs, or defective stairs, can cause individuals to slip, trip, or fall. Inadequate lighting in public areas can also contribute to accidents. If property owners or managers fail to address these hazards or neglect to implement proper safety measures, they may be liable for injuries. Falls or impacts in such situations can result in serious injuries, including thoracic spine fractures, especially if the fall occurs from a height or involves significant force.
How much compensation can be claimed?
This entirely depends on the severity of the injury. In cases where the fracture results in more serious complications such as spinal cord injury, a general damages payout in the region of €150,000-€300,000 may be awarded. According to the Judicial Council’s Personal Injuries Guidelines, an award in this region will be paid when the injury involves “severe pain and disability with a combination of incomplete paralysis and significantly impaired bladder, bowel and sexual function” (see page 30 of the guide here).
