Helpful Information
A thoracic hairline fracture is a small, thin crack in one of the vertebrae within the thoracic spine, which is the middle section of the spine located between the neck and lower back. It is often caused by repetitive stress, trauma, or osteoporosis, leading to weakened bone integrity. Unlike more severe fractures, a hairline fracture does not cause the bone to break completely or displace. Symptoms may include mild to moderate back pain, muscle stiffness, and tenderness in the affected area. Sometimes this type of injury can be caused by negligence on the part of a third party. In these scenarios, it may be possible to bring a personal injury compensation claim.
Can employer negligence cause this type of injury?
Yes. If an employer fails to provide proper training on safe lifting techniques, appropriate safety equipment, or maintains a hazardous work environment, employees may suffer falls or accidents causing fractures. In physically demanding jobs, neglecting to implement rest breaks or ergonomic measures can increase stress on the spine, leading to stress fractures over time. Employers are also responsible for ensuring machinery and equipment are well-maintained and safe to use; failure to do so may result in accidents that cause thoracic hairline fractures.
What steps should employers take to prevent this type of injury?
Employers should provide comprehensive training on safe lifting techniques and ergonomics to reduce spinal strain. Ensuring a safe work environment involves maintaining clean, hazard-free floors and offering appropriate safety equipment, such as back supports. Regular inspections and maintenance of machinery and equipment are essential to prevent accidents. Employers should also implement rest breaks for physically demanding tasks and encourage proper posture. For workers at risk of osteoporosis, promoting bone health awareness and facilitating access to medical evaluations can help.
What compensation can be claimed?
The Judicial Council’s Personal Injuries Guidelines states that “fractures of ribs or soft tissue injuries causing serious pain and disability of short duration” may attract a general damages award in the region of €1,000-€15,000. Compensation depends entirely on the severity, duration, and impact on the quality of life of the claimant. Successful claims may also result in a special damages award to cover any out of pocket expenses relating to the injury.
