Helpful Information
Incidents resulting in gunshot wounds are rare in Ireland. A study conducted at an Irish teaching hospital reviewed gunshot injuries over an eight-year period from 2000 to 2008, identifying 59 patients admitted with such injuries. The majority of these patients were young, male, and unemployed, with most injuries caused by shotguns and affecting the extremities. Occasionally, individuals sustain gunshot wounds due to the negligence of a third party such as the manager of a shooting range. In such circumstances, it may be possible to bring an injury compensation claim.
What are the most common causes of gunshot wounds?
Gunshot wounds are most commonly associated with criminal activities, such as gang-related violence or disputes within organised crime networks. Hunting accidents and the mishandling of legally owned firearms also account for a smaller proportion of cases. While gun ownership is tightly regulated, illegal firearms contribute to incidents resulting in this type of injury. In some very rare cases, domestic disputes and interpersonal conflicts can result in gunshot wounds. Overall, the prevalence of these incidents remains relatively low compared to countries with higher rates of firearm availability.
When is it possible to bring a compensation claim?
An injury claim following a gunshot wound can be brought if the incident resulted from someone else’s negligence, criminal act, or failure to ensure safety. This includes injuries sustained in assaults, workplace incidents, or accidents involving firearms. The claim may be against an individual, employer, or organisation responsible for the circumstances leading to the injury. Legal action must generally be initiated within two years of the incident under Ireland’s statute of limitations for personal injury claims. Supporting evidence, such as medical reports, police records, and witness statements, is essential to substantiate the claim and secure compensation for damages suffered.
Is a solicitor required to bring a claim?
While it is not legally required to consult a solicitor when making an injury claim, it is highly advisable. A solicitor can provide expert guidance on the legal process, ensure compliance with deadlines, and help gather evidence to strengthen your case. They can also negotiate with insurers or represent you in court if necessary, improving your chances of receiving fair compensation. Navigating personal injury claims without professional advice can be challenging, particularly when dealing with complex legal or procedural issues. Consulting a solicitor ensures your rights are protected and maximises the likelihood of a successful outcome.
