The National Ambulance Service is run by the Health Service Executive, and its staff respond to emergencies using motorcycles, cars, and ambulances, often in unpredictable and high-pressure conditions. Some risks come with the job, but many injuries are avoidable, and where one results from a failure to keep you safe, you may have grounds for a claim. Common examples include:

  • an injury from lifting or moving patients without adequate training, equipment, or assistance;
  • an injury caused by an assault by a member of the public, for example someone under the influence of alcohol or drugs, or engaged in criminal behaviour;
  • an injury caused by faulty or poorly maintained equipment;
  • an injury caused by a lack of proper training for a particular type of call;
  • a road traffic accident caused by negligent driving; and
  • a failure to prevent or respond to work-related PTSD and other psychological harm.

Do paramedics have the same right to claim as other workers?

Yes. Paramedics and ambulance staff have the same right to a safe workplace, and the same right to claim, as any other employee. They are protected by the Safety, Health and Welfare at Work Act 2005, which requires their employer, the Health Service Executive, to provide a safe working environment and to take reasonable steps to prevent injury. Where that duty is breached and you are injured as a result, you may be able to claim for your losses, including medical expenses and lost earnings.

Who is responsible for my injury?

It depends on how you were hurt. Where the injury resulted from your employer’s failure to keep you safe, for example inadequate training or faulty equipment, the employer is generally responsible. Where a third party caused it, that party may be liable, so if you were assaulted by a member of the public, the assailant is responsible, and if you were injured in a road traffic accident, the negligent driver is. Where that driver was uninsured or cannot be traced, the Motor Insurers’ Bureau of Ireland may deal with the claim. In some cases more than one party is responsible, and we can help you identify who to pursue.

Can I claim if I was assaulted on duty?

Yes. If you were injured in an assault while carrying out your duties, you may have more than one option. You can pursue the person who assaulted you, and you may also have a claim against your employer if the assault was foreseeable and reasonable protective measures were not in place. Separately, the State’s Scheme of Compensation for Personal Injuries Criminally Inflicted may provide compensation where you were injured by a crime of violence. We can advise on the most effective route in your situation.

How long do I have to make a claim?

In most cases, you have two years from the date of the accident, or from when you became aware of your injury, to bring a claim. This is a strict deadline, and there is also an earlier step of formally notifying the responsible party. Because delays can affect your claim, and because evidence is easier to gather while events are fresh, it is best to take advice as soon as you can.

Do I need a solicitor?

You are not required to use a solicitor, but these claims can be complex, particularly where more than one party may be responsible or where psychological injury is involved. An experienced solicitor makes sure you use the correct process and meet the deadlines, gathers the medical and other evidence to value your claim properly, identifies everyone who may be liable, and deals with the Injuries Resolution Board and the other parties on your behalf.
