A rib fracture is a break or crack in one of the bones of the ribcage, usually caused by direct trauma, such as a fall, car accident, or severe blow to the chest. It can also result from repetitive strain or intense coughing. Rib fractures are often painful, particularly during deep breaths, coughing, or movement. While most fractures heal on their own with rest and pain management, severe cases can involve complications such as lung injury or damage to nearby organs. In scenarios where the rib fracture is caused by the negligent or wrongful actions of a third party, it may be possible to bring a claim for compensation.
What sort of negligent workplace behaviour can cause rib fractures?
This can include a failure to provide proper safety equipment, such as harnesses or guardrails, resulting in falls from heights. Poorly maintained workspaces, like cluttered floors or unstable surfaces, can cause slips or trips. Neglecting to enforce safety protocols, such as lifting heavy objects without assistance or improper use of machinery, can also increase the risk of accidents. Additionally, inadequate training on safety procedures or ignoring ergonomic practices can lead to rib fractures from improper handling of tools or equipment.
What sort of wrongful behaviour can cause this type of fracture?
This can include physical assaults, such as punches, kicks, or other forms of violence directed at the chest. Reckless driving or dangerous behaviour during sports, like tackling or collisions without regard for safety, can also cause such injuries. Engaging in high-risk activities without proper precautions, such as excessive speed in vehicles or unsafe stunts, further increases the likelihood of rib fractures. Additionally, neglecting the safety of others, such as failing to secure heavy objects or acting aggressively in physical interactions, can result in someone suffering a rib injury due to reckless or harmful actions.
How much compensation will be awarded?
Rib fractures causing significant pain and temporary disability can lead to general damages compensation ranging from €1,000 to €15,000 (see page 20 of the Judicial Council’s Personal Injuries Guidelines). Key factors in determining the award include the number of ribs fractured and the severity and duration of the pain experienced. Cases involving long-term or permanent pain are likely to attract compensation exceeding the upper limit, while those where fractures fully heal within a few months will fall at the lower end of the scale. The extent of recovery and ongoing discomfort are central to the final compensation amount awarded. Successful claims may also result in special damages awards to cover lost earnings or any other out of pocket expenses that occured due to the injury.
